I. RETAILER IDENTIFICATION

The ARMORIA website is operated by POWER LAB SARL. Contact: contact@armoria.eu.

II. APPLICATION OF THE TERMS AND CONDITIONS

Any order placed by the Customer implies full and unconditional acceptance of these Terms and Conditions.

III. VALIDITY OF OUR OFFERS

Our offers are intended solely for individual consumers with a physical delivery address. The Site is available in several languages (see the language selector at the bottom of the Site).

Items displayed on the Site are available while stocks last. If an unavailable item has already been charged or paid for, ARMORIA will offer the Customer either a credit note or a refund within 15 days. ARMORIA will also send an email to any Customer who has placed an order for an unavailable item.

IV. PRESENTATION OF PRODUCTS

All products offered for sale are described and presented as accurately as possible. However, ARMORIA cannot be held liable for any errors or omissions that may appear in such presentation.

V. PRICE OF PRODUCTS

All prices are stated inclusive of VAT. For the rest of the world (including DROM-COM and Switzerland), and more generally for territories outside the European Union, prices are mainly shown exclusive of taxes. The amount of VAT is indicated when the Customer selects a product.

We reserve the right to change prices in the event of a change in the applicable VAT rate. Such changes may be reflected in the price of the items without prior notice to the Customer.

ARMORIA reserves the right to change its prices at any time; however, products are invoiced at the price in force at the time the order is registered. Discount codes cannot be used on already discounted items unless otherwise stated, and they apply only to available products sold on armoria.eu. ARMORIA reserves the right to withdraw any promotion at any time without prior notice.

VI. ORDERING AND SECURE PAYMENT

The Customer confirms the order in accordance with the following procedure. By confirming an order, the Customer accepts these Terms and Conditions.

A Customer wishing to purchase one or more items available on armoria.eu must follow the ordering process provided on the Site. After clicking the “Pay Securely Now” button and checking the content of the order (colour, quantity, size, price, etc.), the Customer confirms the purchase with a click.

If the Customer has a discount code, it must be entered in the space provided on the payment page. First-time Customers must complete a short form including the following information: title, first name, surname, full delivery address, email address, date of birth and telephone number. The Customer also creates a password at this stage. Once payment has been confirmed, the contract for the sale of the goods is formed.

VI.I Payment by credit or debit card

The Customer confirms the billing address, the product(s) ordered and the total price. The Customer then enters the card number, expiry date and security code, and finalises payment by clicking the “Confirm” button.

VI.II PayPal

With PayPal, your financial information is never disclosed to ARMORIA. PayPal encrypts and protects your card number. You can pay online simply by entering your email address and password.

VI.III Payment by bank transfer

Simply select “bank transfer” and confirm the order. You will receive our bank details by email together with a reminder of the order amount and a unique transaction reference to include when making the transfer. We will start preparing your order once your bank transfer has been received (this generally takes about 5 working days, depending on interbank processing times).

American Express is accepted on armoria.eu.

VI.V Payment default

ARMORIA reserves the right to refuse to honour an order placed by a consumer who has not fully or partially paid for a previous order, or with whom a payment dispute is currently being handled.

VI.VI Payment verification

ARMORIA monitors all orders confirmed on the Site, and all payments made through armoria.eu may be subject to security checks carried out both by the card issuer and by ARMORIA. This monitoring is intended to protect ARMORIA from fraudulent or abusive practices and to protect our Customers against unauthorised use of their payment details.

Our services may contact you by email or telephone to confirm your order information and order details, and may request supporting documents such as proof of address, proof of debit in your name, or proof of address in the name of the person indicated for delivery.

This order verification is carried out before your order is prepared and may cause a delay in the preparation and dispatch of your order.

VI.VII Payment security

To ensure secure payments, ARMORIA uses the secure payment service provided by STRIPE. This service uses the SSL security standard. Confidential data (16-digit card number, expiry date and security code) are encrypted and sent directly to the bank server without passing through the physical server of armoria.eu.

When the order is validated, the payment request is routed in real time to the secure remote payment manager, which submits an authorisation request to the bank card network. The remote payment manager issues an electronic certificate serving as proof of the amount and date of the transaction in accordance with Luxembourg law.

VII. IDENTIFICATION

Customers who have already made a purchase on armoria.eu may choose a password allowing them to place new orders without having to fill in the customer information form again. A Customer who has already registered is recognised on the Site as an ARMORIA customer. The Customer’s password is strictly confidential and personal and must never be disclosed to any third party.

If a Customer has lost or forgotten their password, they should contact customer service by email at contact@armoria.eu. A new password will be issued within 48 hours to replace the previous one.

To facilitate Customer identification through the use of both the email address and password, the Customer expressly authorises ARMORIA to place a “cookie” on the Customer’s computer solely for the purpose of facilitating such identification.

VIII. DELIVERY

Delivery times are calculated from the order date and are expressed in working days (Saturdays, Sundays and public holidays are not taken into account in the calculation of delivery times). In the event of force majeure, ARMORIA cannot be held responsible for any delay in delivery.

The delivery methods available for the desired product(s) are shown on the product page and on the payment page.

If a single order contains several products and two different delivery methods, the Customer may receive two separate parcels.

IX. MONEY-BACK GUARANTEE

All items purchased on armoria.eu may be returned. Products may be exchanged or refunded. To be accepted, returned items must meet all of the following conditions:

- they must never have been worn outdoors and must be in their original condition;
- they must be returned in their original packaging, in good condition;
- they must be returned within 15 days of receipt of the order;
- the return procedure must be followed.

X. DISPATCH AND DELIVERY PROBLEMS

If a parcel is returned due to an incorrect address or because it was unclaimed, ARMORIA does not guarantee that the ordered items will be reserved and may refund the order if the products are no longer available.

X.I Returns due to an incorrect address

These are parcels returned by the carrier with a mention indicating that the recipient does not live at the address provided or that the address is incorrect or incomplete. Once your parcel has been received and accepted by our services, ARMORIA will contact the Customer either to resend the order, if the product is still available, or to proceed with a refund, according to the Customer’s preference.

ARMORIA reserves the right to refund the order and not to resend it in the event of several repeated incorrect-address returns.

X.II Returns due to an unclaimed parcel

These are parcels that have not been collected by the Customer from the post office or relay point within the time limit indicated. Once your parcel has been received and accepted by our services, ARMORIA will contact the Customer either to resend the order, if the product is still available, or to proceed with a refund, according to the Customer’s preference.

ARMORIA reserves the right to refund the order and not to resend it in the event of several repeated unclaimed-parcel returns.

XI. LIABILITY

For all stages of access to the Site, consultation, completion of forms, ordering, delivery of items or any other service, ARMORIA is bound only by a best-efforts obligation. Consequently, ARMORIA cannot be held liable for any inconvenience or damage inherent in the use of the Internet and entirely external to the diligence and precautions taken by ARMORIA.

In particular, any disruption in service availability, any external intrusion or any presence of computer viruses shall not engage the liability of ARMORIA. Likewise, any event qualifying as force majeure under applicable case law shall release ARMORIA from liability. Customers benefit from the guarantees granted by the brands available on the Site.

XII. INTELLECTUAL PROPERTY

All elements of the ARMORIA website, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents. They are the exclusive property of POWER LAB and/or its partners.

Any hyperlink referring to the ARMORIA website and using framing, deep-linking, in-line linking or any other deep-link technique is formally prohibited. In all cases, any link, even if tacitly authorised, must be removed at the request of ARMORIA.

XIII. PROTECTION OF PERSONAL DATA

XIII.I Collection of personal data

For the purposes of providing its services, POWER LAB, through the ARMORIA website, may collect personal data relating to users of the Site, in particular through the use of a “cookie” referred to in Article VII. POWER LAB reserves the right to use commercially the data collected on its website, subject to the Customer’s rights and applicable law.

In any event, and in accordance with applicable data protection law, any user or Customer of the Site may at any time object to the commercial use of such data and has a right of access, rectification and deletion of data concerning them.

All requests relating to this article should be sent by email to contact@armoria.eu.

The term “personal data” means any data that identifies an individual, including, for example, surname, first name, telephone number, date of birth, gender, email address, postal address, IP address, and any information that the Customer chooses to communicate to POWER LAB.

For the purpose of combating fraud, POWER LAB may also retain for a limited period information relating to transactions carried out on its sites, including a truncated portion of the bank card numbers used to carry out those transactions and their expiry date.

XIII.II Purpose of data collection

Personal data is collected only for specified, explicit and legitimate purposes in order to fulfil one or more of the following purposes:
- managing orders on the Site;
- producing commercial statistics and carrying out market and behavioural studies;
- creating and managing prospect files, including technical operations such as standardisation, enrichment and deduplication;
- carrying out operations relating to customer management;
- selecting a customer base for canvassing and promotional activities;
- sending requests, offers and promotional messages from POWER LAB, from which the Customer may unsubscribe at any time by clicking on the link provided at the bottom of the relevant emails;
- complying with legal and regulatory obligations;
- combating fraud.

XIII.III Recipients of collected data

Only POWER LAB and external companies contractually bound to POWER LAB for the processing of the Customer’s order have access to the information communicated. Within POWER LAB, and within the limits of their respective responsibilities, the persons likely to have access to personal data are members of the commercial, administrative, technical and control departments (auditors, internal control procedures, etc.).

Personal data may also be sent to public authorities solely in order to comply with legal obligations, to legal auxiliaries, ministerial officers and bodies responsible for debt collection.

All necessary precautions are taken to preserve the security of personal data and, in particular, to prevent it from being distorted, damaged or accessed by unauthorised third parties.

POWER LAB reserves the right to use commercially the data collected on the Site where the Customer has consented to receive partner offers from POWER LAB. The Customer may withdraw such consent at any time. Any processing based on consent given before withdrawal remains lawful. POWER LAB may have to transfer such data to foreign companies and undertakes to communicate such data only to companies offering a level of protection equivalent to that required within the European Union.

XIII.IV Retention of personal data

The data collected is retained for a period of five years from the last transaction carried out on the Site or from the last update of the Customer account. Certain banking data, such as truncated bank card numbers and expiry dates, may be retained for a period of 13 months for anti-fraud purposes. The cryptogram is systematically destroyed after the transaction has been effectively completed, fully paid and not challenged.

As part of a service allowing the memorisation of payment details, the Customer may consent to the retention of truncated bank card numbers and their expiry dates for a period of thirteen months from the last transaction made on the Site or the last update of the Customer account. This consent is expressed by checking the “Remember” box. The Customer may subsequently withdraw this consent at any time by unchecking the same option.

In the absence of a new transaction or update to the Customer account during the five-year period, the data concerning the Customer will be automatically deleted.

XIII.V Cookies

POWER LAB measures the number of page views, the number of visits, visitor activity on the Site and how often visitors return, using cookie technology. A cookie does not identify the Customer personally. It records information relating to the browsing activity of the Customer’s computer on the armoria.eu website (pages viewed, date and time of consultation, etc.) so that it can be read during subsequent visits. Data collected by cookies is strictly for internal use and is never transmitted to third parties.

The use of first-party or third-party cookies that are not necessary for the proper functioning of the Site requires the Customer’s express consent. Consent to, or refusal of, the use of cookies may be expressed by appropriate browser settings.

Some cookies known as “advertising cookies” make it possible to track the Customer’s browsing activity and to record the products viewed, then, within 90 days, to display advertising banners related or unrelated to previous browsing activity. These cookies are linked to the Customer’s internal profile, without making it possible to identify the Customer personally. They also require the Customer’s express consent in the same way as indicated above. XIII.VI Right of access and rectification

When the Customer communicates personal data, the Customer expressly consents to the collection and use of such personal data under the conditions set out herein.

In accordance with Regulation (EU) 2016/679, the Customer has the right to access, rectify, restrict, transfer and question the data concerning them and, where applicable, to object to the processing of such data. These rights may be exercised by:

For legitimate reasons, the Customer may object to the processing of data concerning them or limit its use. The Customer may also lodge a complaint with the competent supervisory authority.

XIII.VII Reciprocity

The Customer undertakes, for their part, to respect any data communicated by POWER LAB in the course of any data collection or exchange, not to disclose such data and to keep it strictly for personal use. POWER LAB reserves the right to refuse to communicate such data and/or to require the Customer to delete it.

XIV. GAMES AND COMPETITIONS

Quizzes organised by ARMORIA are free of charge and require no purchase. They are open to anyone residing in the European Union. Winners are notified by email and receive their prize in the form of a voucher code or ARMORIA gift card. Unless otherwise specified, the voucher or gift card is valid once on the entire website, excluding promotional items, and cannot be combined with other promotional offers.

Unless otherwise specified for a given operation, vouchers are valid for three months and gift cards for one year. If the amount of the gift card exceeds the value of the Customer’s order, the remaining balance will be credited to the gift card account and automatically proposed during the next order on the payment page. If the amount of the gift card is lower than the value of the Customer’s order, the difference must be paid by bank card.

ARMORIA will never disclose the names or email addresses of participants. By entering their email address, participants agree to receive the ARMORIA newsletter. ARMORIA reserves the right to postpone or cancel a quiz and cannot be held liable for any problem that may arise during the operation.

For each quiz organised, there will be only one winner per household (same name, same physical address or same IP address). In the event of a return, a voucher won through a quiz cannot be re-used. Participation in any game implies full acceptance of these rules. The rules may be amended at any time by an addendum issued by the organiser, subject to compliance with the conditions previously stated. Any fraud or attempted fraud committed for the purpose of improperly obtaining a benefit may result in legal proceedings.

XV. PRIVATE SALES

Products sold as part of ARMORIA private sales are accessible to persons who meet at least two of the following conditions:
- being an ARMORIA customer by opening an account on the website with a valid email address and password;
- having received an electronic invitation at the email address linked to the account;
- having received at least one email from ARMORIA.
